Terms and conditions
These terms govern your use of delayrepay.io(the "Service"). By accessing or using the Service, you agree to them. If you do not agree, do not use the Service.
1. Who we are
The Service is operated by the publisher of delayrepay.io("we", "us"). We are not a train operator, ticket retailer, or government body. We are not affiliated with National Rail, Network Rail, or any train operating company unless we say so in writing elsewhere.
2. The Service
delayrepay.io provides tools to explore historic rail journey information, indicative Delay Repay-style eligibility and compensation estimates, and helpers to prepare information you may use when dealing with operators. The Service is offered as a public beta: features, data, and availability may change or stop without notice.
We do notsubmit claims, refunds, or compensation requests to any operator on your behalf. Anything you do with a third party (for example an operator's claim form) is between you and them.
3. Not advice; no guarantee
Content on the Service is for general information only. It is not legal, financial, tax, or travel advice. Delay Repay and compensation rules differ by operator, ticket type, and circumstances. Eligibility outputs, estimates, and wording suggestions may be incomplete, outdated, or wrong for your situation.
Operators decide eligibility and payment in line with their own terms and conditions. You are responsible for checking current rules and for any claim you make.
You must only use the Service to support claims that are truthful and relate to journeys you actually made (or attempted, where disruption prevented travel), with a ticket valid under the operator's scheme. You must not use the Service to prepare fraudulent, exaggerated, or misleading claims.
4. Accounts
Where we offer accounts, you must provide accurate information and keep your sign-in details confidential. You are responsible for activity under your account unless you tell us promptly of unauthorised use. We may suspend or close accounts that breach these terms or put the Service or others at risk.
5. Acceptable use
You agree not to:
- Use the Service unlawfully or in a way that harms, overloads, or interferes with it or others.
- Attempt to gain unauthorised access to systems, data, or accounts connected to the Service.
- Scrape, resell, or redistribute bulk data from the Service in breach of these terms or applicable third-party terms.
- Use the Service to send spam, malware, or misleading content.
- Use the Service to prepare or support fraudulent, dishonest, or misleading compensation claims.
6. Third-party services and data
The Service relies on infrastructure and data sources we do not control (for example hosting, analytics, and National Rail historic performance APIs). Those providers have their own terms and may process data as described in our Privacy policy. Outages, errors, or changes in third-party data may affect results shown on the Service.
7. Intellectual property
We (or our licensors) own the Service, its branding, and its original content, subject to any open-source licences that apply to underlying components. You may use the Service for your personal, non-commercial exploration of the features we offer; you must not copy our software, bypass technical limits, or remove notices.
8. Disclaimer of warranties
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including fitness for a particular purpose and non-infringement.
9. Limitation of liability
Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law (including death or personal injury caused by negligence, or fraud).
Subject to that, we are not liable for any indirect, consequential, or special loss, or for loss of profit, data, goodwill, or business. Our total liability arising out of or in connection with the Service in any twelve-month period is limited to £50, except where a higher minimum applies by law.
You use historic data, estimates, and eligibility indicators at your own risk. We are not liable for decisions you make with operators, banks, or insurers.
10. Changes
We may change these terms or the Service. We will post the updated terms on this page and update the "Last updated" date. Continued use after changes constitutes acceptance where the law allows. If you do not agree, stop using the Service.
11. Governing law and disputes
These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, subject to mandatory consumer protections where you live in the UK or EEA.
